Terms and Conditions

ENTRY:
  • Payment of the entrance fee confirms agreement to abide by all terms and conditions set out in this document, and any requests made by Dark-Media organizers on the day. Failure to comply may result in access to the network being denied, or ejection from the venue.
  • If an entrant fails to leave the venue when asked, or uses threats or violence, onsite security or the police may be called to remove the person by force.
  • Payment of one entry fee entitles one person to bring:
    • One computer system
    • One display device
    • Necessary peripherals.
  • Dark-Media Provides one network port and power sufficient for these devices. Should anyone wish to bring two PC's, or additional equipment, they may be asked to pay a surcharge.
  • Entry to a Dark-Media event is at the entrant's own risk. In paying and entering the venue the entrant is accepting this risk. Dark-Media takes no responsibility for any loss, damage or personal injury incurred whilst at the event, or on the premises.
BEHAVIOUR:

The following applies to all participants and spectators attending or planning to attend Dark-Media LAN

  • No threats of physical violence (whether intentional or otherwise).
  • Behaviour considered by the organisers to be disruptive to other players.
  • Possession and or use of weapons, including but not limited to firearms, knives, batons, torches, rubber band guns, replica guns, or any object used in a threateningmanner or interpreted to be in a threatening manner.
  • Participants can only bring a one screen and cannot exceed the maximum size of 24 inches.Using, stealing, damaging or reconfiguring another person's equipment without their express permission.
  • No material which could be classified as 18+ may be displayed on your monitor at any time.
  • Shouting, screaming or excessively loud behaviour is not permitted during the event; a first offence is the final offence.
  • You must own registered versions of all software.
  • Will not participate in, allow, or encourage the violation of copyright laws pertaining to software licensing, including leeching, pirating, cracking, reverse engineering, or other activities surrounding the violation of copyright laws.
  • The organisers reserve the right to deny entry to any person. A first offence is the final offence.
  • All decisions by Dark-Media Administrators are final and no discussion will be entered into.
  • The organisers reserve the right to confiscate any materials considered dangerous or/and prohibited by the event rules.
  • No consumption of alcoholic beverages or illicit drugs is permitted at Dark-Media LAN events.
  • Dark-Media take no responsibility for any person's equipment, possessions, or actions.
  • No smoking is permitted within Dark-Media LAN venue.
  • You must sign in and pay at the front desk before entering the hall/playing areas.
  • Dark-Media takes no responsibility for any materials that lost or stolen.
  • Clan Leaders are responsible for their team (i.e. joining a server on time).
  • If your team is unable to be ready within 5 minutes of being called you will forfeit the match.
  • You must not enter the designated for administrators area during the event unless expressly invited.
  • You may only connect a single network cable for your PC to Dark-Media network. Any other networking equipment or additional cables must be approved by Dark-Media Administrators.
  • You must configure your network settings automatically by Dark-Media DHCP (Dynamic Host Configuration Protocol) server or by settings provided by a Dark-Media Administrator only.
  • Cheating is not permitted.

Any participant or spectator breaching these guidelines will be subject to at the minimum but not limited to the following penalties.

  • Immediate disconnection from Dark-Media LAN network.
  • Revoking of rights to any prizes, freebies or giveaways
  • Forcibly removal from the venue by security and/or be handed over to the police.
  • Permanent ban from any Dark-Media event.

The organisers reserve the right to deny entry, or evict, by force if necessary, any person for any reason, without stating or justifying the action, and without penalty to Dark-Media, legally or financially.

SECURITY:

Trained security personnel may patrol the event. People found being nuisances may be forcibly removed from the venue. Players are advised to follow behaviour guidelines at all times. Instructions announced by administration of the event must be followed at all times. Please ensure that everything you bring, especially computer hardware is clearly labelled with at least your Playing name, but preferably also a real name and address or phone number. Your property is your responsibility.

USER AGREEMENT:

Please read this User Agreement carefully. This Agreement ("Agreement") governs the use of Dark-Media Networks ("Service") and Dark-Media LAN ("Service") including participation in chat and bulletin-board or forum facilities ("Discussion Areas"). You can access this Agreement at any time from the bottom of any page of the Service and a copy in its final form will be posted on Dark-Media LAN Intranet.

Because the Service is designed to provide an enjoyable experience for all its users must abide by certain rules. Your enrolment and use of the Service will constitute your agreement to be bound by and comply with these rules and any changes or revisions to the Agreement. If and when the terms are changed, Dark-Media will notify you by posting a notice in the "Dark-Media News" section or on Dark-Media LAN Intranet and you agree to be bound by all of the changes as well so it's wise to check this page regularly. You should consult the "Dark-Media News" section each time you access this site or Dark-Media LAN Intranet.

Your failure to follow Dark-Media’s rules, whether listed below or in supplemental notices may result in termination of your access to the Service, without notice, in addition to Dark-Media’s other remedies. These rules are to help ensure a smoothly run event and a fast network so that everyone has a good time.
If you do not agree with the rules contained in this Agreement, please do not enrol.

Comments by Users Are Not Endorsed by Dark-Media

1.1 Dark-Media does not necessarily endorse, support, sanction, encourage, verify or agree with the comments, opinions or statements posted by users in Discussion Areas or elsewhere in the Service. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of Dark-Media.

Use of the Service by You

2.1 Your right to use the Service is personal to you: You may not authorise others to use the Service, and you are responsible for all of your own use of the Service.

2.2 You agree not to use any obscene, indecent or offensive language, or to place on the Service any material that is false, defamatory, abusive, harassing or hateful. Further, you may not place on the Service any material that is encrypted, constitutes junk mail or unauthorised advertising, invades anyone's privacy, encourages conduct that would constitute a criminal offence or give rise to civil liability, or that otherwise violates any law or regulation. You agree to use the Service only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability.

2.3 Other than connecting to Dark-Media’s servers by authorised HTTP requests using a Web browser, you may not attempt to gain access to Dark-Media's servers by any means including, without limitation, by using administrator passwords or by masquerading as an administrator or other player while using the Service or otherwise.

2.4 You are responsible for ensuring that you do nothing to violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party. This will be strictly enforced too.

2.5 Material on the Service is for your personal use only. Material whether it be information or software or anything else received through the Service is to be used solely for internal purposes. Except with prior express written authorisation from Dark-Media, nothing received through the Service may be duplicated, reproduced, distributed, or otherwise disseminated, in whole or in part, in any form. The Service contains copyrighted and other proprietary information. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, copying, distribution, performance, caching or otherwise, of material obtained through the Service, except as permitted by Dark-Media, the Copyright Act or other law.

2.6 You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way, and you agree not to impede or interfere with others use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, the Service.

2.7 The System is monitored to ensure proper operation, to verify the functioning of the network, games, information features, and for other like purposes. Anyone using this system expressly consents to such monitoring and is advised that if such monitoring reveals possible evidence of undesirable activity, system personnel may provide the evidence of such monitoring to appropriate officials and you may at the sole discretion of Dark-Media LAN be excluded from the remainder of Dark-Media LAN and the right to take other appropriate action is reserved.

2.8 You acknowledge that Dark-Media has not reviewed and does not endorse the content of all sites linked to from this Service and is not responsible for the content or actions of any other sites linked to from this Service. Linking to any other service or site from this Service is at your sole risk.

Use of Material Posted by You

3.1 Postings to the Discussion Areas are not private. You grant Dark-Media and its designers the unrestricted right to use, reproduce, modify, translate, transmit and distribute any information or material you supply or communicate to the Service via such postings, in any medium now in existence or hereafter developed, for any purpose, including commercial uses.

Materials Provided by Others

4.1 You agree that Dark-Media is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive, or illicit material.

Indemnification

5.1 You agree to indemnify Dark-Media and its affiliates, sponsors, employees, agents and representatives, and to hold them blameless from any and all claims and liabilities (including legal fees) that may arise from your submissions, from your unauthorised use of material obtained through the Service, from your breach of this Agreement, or from any such acts arising through your use of the Service.

Editing and Deletions

6.1 Dark-Media reserves the right, but undertakes no duty, to review, edit, and move or delete any material posted by users in the Discussion Areas or elsewhere on the Service, in its sole discretion and without notice.

Additional Rules

7.1 Dark-Media reserves the right to post, from time to time, additional rules of usage that apply to specific parts of the Service. Such additional rules will be posted in the relevant parts of the Service, and will be clearly identified. Your use of the Service constitutes your agreement to comply with these additional rules.

7.2 Dark-Media reserves the right to change, remove and/or replace, any and all prizes, without notice, at any time.

Disclaimer of Warranty and Limitation of Liability

8.1 You acknowledge that you are using the Service at your own risk. The service is provided "as is," and Dark-Media, its sponsors and affiliates hereby expressly disclaim any and all warranties, express and implied. You certify that you possess knowledge and experience in computer matters and are capable of evaluating the merits and risks of attending Dark-Media LAN and (where applicable) allowing your computer to be used in Dark-Media LAN.

8.2 Dark-Media may discontinue or change the Service or its availability to you, at any time, for any reason, without notice. Dark-Media and its affiliates do not represent or warrant that access to the service will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted on the service, or that power will be lost to the service. You agree that no liability shall be attributed to Dark-Media, its affiliates, agents, sponsors and licensors (if any) arising out of any kind of legal claim in any way connected with the Service or the information in the Service including any claims arising in negligence or contract.

 8.3 Dark-Media and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the service, including for viruses alleged to have been obtained from the service, your use of or reliance on the service or any of the information or materials available on the service, regardless of the type of claim or the nature of the cause of action (including contract or negligence or both of them), even if advised of the possibility of such damages.

8.4 Each party releasing claim herein agrees that he or it will not bring, commence, maintain, prosecute or affirmatively instigate, directly or indirectly, any legal or administrative proceeding against any party released by such releasing party, based upon any act or omission claims for which are released in this stipulation and order. No waiver by any of the parties of any default shall operate as a waiver of that default or any other default, or of the same default on a future occasion, by any party.

 8.5 By accessing this site or any of its hypertext links, or by enrolling you agree to fully indemnify, defend and hold harmless Dark-Media, its events Dark-Media LAN, Dark-Media LAN sponsors their officers, directors, employees and shareholders, from any and all claims of any kind arising out of participation in Dark-Media LAN or use of the Service.

Termination

 9.1 Dark-Media has the right to terminate your ability to access the Service, for any reason, without notice.

Jurisdiction

10.1 This Agreement shall be governed and construed in accordance with State and Federal law, and you agree to submit to the jurisdiction and venue of this State.

Entire Agreement

This Agreement is the complete and entire agreement between the parties and supersedes any prior agreement, whether written or oral. Dark-Media assumes implicit agreement of the above terms and conditions by your physical presence at the event, or within 10 metres of the location specified as the event locale.

All decisions made by organisers legally recognised as representing Dark-Media are final and no discussion will be entered into. Dark-Media reserves the right to change this Agreement at any time by posting a new agreement at this location.
